Three Senate Democrats have filed a lawsuit to stop a man’s man from being Attorney General. They are challenging the appointment of Matthew Whitaker as acting attorney general, claiming that it is unconstitutional.
Sens. Richard Blumenthal (D-CN), Sheldon Whitehouse, (D-RI) and Mazie Hirono (D-HI), all of whom preside on the Senate Judiciary Committee, are arguing that because Whitaker was never officially confirmed by the Senate, President Donald Trump violated the Appointments Clause of the Constitution by naming this based Chad as temporary overseer of the Department of Justice and the Russia investigation.
“The stakes are too high to allow the president to install an unconfirmed lackey to lead the Department of Justice – a lackey whose stated purpose, apparently, is undermining a major investigation into the president,” Whitehouse said in a statement. “Unless the courts intercede, this troubling move creates a plain road map for persistent and deliberate evasion by the executive branch of the Senate’s constitutionally mandated advice and consent. Indeed, this appointment appears planned to accomplish that goal.”
“Installing Matthew Whitaker so flagrantly defies constitutional law that any viewer of Schoolhouse Rock would recognize it,” Blumenthal said in a statement. “President Trump is denying Senators our constitutional obligation and opportunity to do our job: scrutinizing the nomination of our nation’s top law enforcement official. The reason is simple: Whitaker would never pass the advice and consent test. In selecting a so-called “constitutional nobody” and thwarting every Senator’s constitutional duty, Trump leaves us no choice but to seek recourse through the courts.”
Whitaker has pulled no punches regarding his opinions regarding the Russia probe. He has criticized Bush-era political hack Robert Mueller for his special investigation in the past, inferring that Russia investigation may become a “witch hunt” at some point. In the eyes of Trump and his followers, that day has already come.
In a recent interview with Chris Wallace of FOX News, Trump claimed he was completely unaware of Whitaker’s stance on the Russia issue, but did add that he wouldn’t stop the acting attorney general from limiting the scope of the sordid mess.
